- The data controller according to Article 4(7) of the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "GDPR") is Simpleship Logistics s.r.o., with its registered office at Korunní 2569/108, Vinohrady (Prague 10), 101 00 Prague, ID: 19424353, VAT ID: CZ19424353, registered in the public register kept by the Municipal Court in Prague, Section C, Insert 386349 (hereinafter referred to as the "Controller").

- The Controller has not appointed a data protection officer.
- Sources and Categories of Processed Personal Data
- The Controller processes personal data that you have provided to them or obtained based on the handling of Shipments and the performance of other related transport activities (hereinafter referred to as the "Service") or registration on the Controller's websites (hereinafter referred to as the "Ordering System").

- name and surname
- company name (entity), ID number and VAT ID and contact person at companies
- contact details
- address
- email address
- telephone number
- bank details (bank account number for cash on delivery purposes)

- Legal Basis and Purpose of Processing Personal Data
- The legal basis for processing Personal Data is:
- the performance of a contract or taking steps prior to entering into a contract between you and the Controller or the recipient of your Personal Data under Article 6(1)(b) GDPR,
- the legitimate interest of the Controller in providing direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(f) GDPR.
- The purpose of processing Personal Data is:
- processing your order, handling any complaints, and fulfilling the rights and obligations arising from the contractual relationship between you and the Controller or the recipient of your personal data,
- assessing satisfaction with purchases via email questionnaires,
- sending commercial communications and conducting other marketing activities.
- Data Retention Period
- The Controller retains Personal Data:
- for the period necessary to perform the rights and obligations arising from the contractual relationship between you and the Controller and to enforce claims arising from these contractual relationships (for a period of 15 years after the termination of the contractual relationship),
- for the period until a valid objection is raised against the processing of Personal Data or until consent to process Personal Data for marketing purposes is withdrawn, up to 5 years from the last contract.
- After the expiration of the retention period for Personal Data, the Controller will erase this data.
- Recipients of Personal Data (Subcontractors of the Controller)

The Controller carries out the processing of Personal Data, but these data may also be processed by the following entities:
- carriers involved in the execution of Shipment transport,
- entities providing payment operations, operating a web application, and other services related to the company's activities,
- pick-up points and their operators,
- entities ensuring sales channels, marketing, and emailing services,
- entities providing feedback and questionnaire surveys with consent.
- b) These notably include ComGate Payments, a. s., General Logistics Systems Czech Republic s.r.o., Direct Parcel Distribution CZ s. r. o., FedEx Express Czech Republic s.r.o., UNITED PARCEL SERVICE CZECH REPUBLIC, s.r.o., SendGrid, Inc., Facebook, Google LLC (Google Adwords, Google Analytics, Google Drive), Seznam.cz, a.s., and possibly other providers of software, services, and applications currently not utilized by the Controller.
- c) The Controller intends to transfer Personal Data to a third country (a country outside the EU) or an international organization. Recipients of Personal Data in third countries are providers of mailing and cloud services. If the Shipment has a delivery destination outside the EU, you agree to the transfer of Personal Data to a Processor located outside the EU.
- Your Rights

Under the conditions set out in the GDPR, you have the following rights:
- the right to access your Personal Data under Article 15 GDPR,
- the right to rectify Personal Data under Article 16 GDPR or to restrict processing under Article 18 GDPR,
- the right to erase Personal Data under Article 17 GDPR,
- the right to object to processing under Article 21 GDPR,
- the right to data portability under Article 20 GDPR,
- the right to withdraw consent to processing in writing or electronically to the address or email of the Controller stated in Article III of these terms,
- in case of doubts about compliance with obligations related to the processing of Personal Data, please contact us or the Office for Personal Data Protection.
- Conditions for Securing Personal Data
- The Controller declares that it has adopted all reasonable technical, administrative, and physical security measures to protect the security of Personal Data.
- Only persons authorized by the Controller have access to Personal Data. Employees, suppliers, and representatives who have access to Personal Data are obliged to keep this information confidential and must not use it for purposes other than those stated above or deal with it without consent.
- Final Provisions
- By submitting an order through the Ordering System, you confirm that you are familiar with the terms of Personal Data protection and agree to them in full.
- The rights and obligations of the contractual parties in processing the Personal Data of Recipients and Senders of Shipments are regulated by the Personal Data Processing Agreement, which is Annex 2 to these Terms and Conditions.
- If any provision of the terms or its part is considered invalid for any reason, it will be deemed omitted for that purpose. This fact does not affect the validity of the remaining parts of the terms.
- The Controller is entitled to change these terms. The new version of the Personal Data protection terms will be published on its website.
These terms come into effect on 25.05.2018.
